After marrying Olesia on 2011-08-31 in Irkutsk, Russia, I applied for Family Class Sponsorship and Permanent Residence for my beloved spouse Olesia Sunatori and our lovely child Iaroslava Sunatori. I gathered documents, completed the application, paid the fees, and finally submitted the application on 2011-12-22 via XpressPost. The envelope was promptly received by the Case Processing Centre - Mississauga the following day on 2011-12-23.
On 2012-02-21, I received the entire package back with a letter dated 2012-02-15 stating the following:
A newly completed Sponsorship Questionnaire (IMM 5540) bearing an original signature of yourself. This must be received at this office by: 02/15/2012.
Firstly, when I submitted the forms on 2011-12-22, I followed exactly the instructions in "Family Class Sponsorship of a spouse, common-law partner, conjugal partner or dependent child living outside Canada, Part 1: The sponsor's guide (IMM 3900E)". Page 26 of the latest sponsor's guide (IMM 3900E) for the Sponsor Questionnaire (IMM 5540) explicitly says the following. Since I am a resident of Québec, I did not include the Sponsor Questionnaire (IMM 5540) in my original submission.
Residents of Québec do not need to complete this form.
Secondly, this letter from the Case Processing Centre is dated 2012-02-15, and I received it on 2012-02-21. Therefore, it is absolutely impossible for me to make the newly completed Sponsorship Questionnaire (IMM 5540) bearing an original signature of myself be received at this office by 2012-02-15 without a time machine.
I filled out and submitted the Sponsorship Questionnaire (IMM 5540) anyway on 2012-02-22 via XpressPost. The envelope was promptly received by the Case Processing Centre - Mississauga the following day on 2012-02-23.
In view of these submissions of facts, I asked CIC to process my application promptly, without any additional delays. I felt that I should not be penalized in terms of processing time because it was an error by the Case Processing Centre.
I sought assistance from my Member of Parliament (MP) via e-mail, CC'd to the Minister of Citizenship, Immigration and Multiculturalism. Her office promptly called me back, but they would not intervene until the Total Application Processing Time which is published on CIC's website is reached.
On 2012-02-15, I received a letter from Citizenship and Immigration Canada (CIC) stating that my daughter Iaroslava "may be eligible for Canadian Citizenship and does not require Immigration Sponsorship". CIC unilaterally refunded my application fee of $150 CAD, so I did not have a choice. So, I immediately followed the instruction in the letter to apply for a Citizenship Certificate (Proof of Canadian Citizenship) for my daughter Iaroslava. I also provided Citizenship and Immigration Canada with additional documentation as soon as it was requested on 2012-03-29.
Again, I contacted my MP via e-mail, CC'd to the Minister, because my daughter Iaroslava would not be admitted to Canada without her Citizenship Certificate. The agent at CIC's call centre told me that it may take 8 extra months because my daughter Iaroslava lives abroad with her mother Olesia. My MP ignored my repeated requests for assistance due to CIC's errors.
On 2012-08-23, however, my spouse Olesia received an e-mail message from the Canadian Embassy in Moscow, Russia, stating that my daughter Iaroslava "may not be entitled to the Canadian Citizenship based on the information that we have".
As a sponsor, I immediately requested to CIC that my daughter Iaroslava be included in the current Family Class sponsorship as my spouse Olesia Sunatori's dependent child. I marked the envelope with "ADD-ON" and "Urgent". I asked them to expedite the process because our 20-month-old child should be raised by both mother and father.
We were desperately struggling to finally re-unite as a family after 1 year of separation since our marriage, due to bureaucracy (Russian) after bureaucracy (Canadian). This exceptional case has put us into an extremely difficult situation.
On 2012-09-11, more than 1 year after our marriage, the Promise of Visa letter (POVL) was issued on condition that Olesia submits another police certificate. It meant yet another delay of "30 working days" by the Russian bureaucracy. Could anybody please explain why such repetition of police certificate is necessary?
On 2012-09-26, I received a telephone call from an immigration officer at CIC telling me that CPC - Mississauga has not received the original of Iaroslava's ADD-ON Family Class sponsorship application. She said that the application in FAX was received, but the original was missing. It is probably the PDF attachment that I sent to the Canadian Embassy in Moscow on 2012-08-23. I explained to her that the POVL had already been issued. Later on the same day, I received a letter from CPC Mississauga via e-mail confirming that the FAX has been approved as the original.
On 2012-10-15, Olesia and Iaroslava finally received the Permanent Resident Visa (PRV) to Canada on their external passports, after I had already left Canada for Irkutsk to bring them back to Canada. On 2012-10-16, we were re-united at last, after 14 months of separation!
On 2012-10-21, we landed at Toronto's Pearson International Airport. It was just before Iaroslava's 2nd birthday, so she was able to travel on a lap seat. Also, it was 5 days before CIC institutes a 2-year delay on permanent resident status for sponsored foreign spouses and partners, effective immediately.
2 weeks after Olesia and Iaroslava received the Permanent Resident Visa (PRV) and 1 week after they already landed in Canada, CIC's Client Application Status changed to "A decision has been made on Olesia Sunatori's application. The office will contact Olesia Sunatori concerning this decision."
Here are some contributing factors.
Olesia's name change from Olesya Musikhina to Olesia Sunatori -> Russian bureaucracy
Québec process -> Canadian bureaucracy (CIC's mistake)
1-year old child -> Canadian bureaucracy (CIC's mistake)
No immigration lawyers or immigration consultants
The Canadian Embassy in Moscow said: "We are experiencing a temporary increase in processing times due to seasonal volumes and other factors outside our control."
I hereby make the following concrete proposals to CIC/MICC/MP/Minister for process improvement in order to prevent inquiries to the call centre and mitigate aggravation because there is a vicious cycle to delay CIC's processing further and further with excessive inquiries via numerous telephone calls and e-mail messages about the status of immigration process due to unreasonable processing time of many months.
On GENERIC APPLICATION FORM FOR CANADA (IMM 0008), make the question in Application Details - 7 c) "If no, when did you apply for your CSQ?" optional for Family Class Sponsorship because you are supposed to do so after CIC approves sponsorship.
Make Sponsor Questionnaire (IMM 5540) mandatory for all applicants. The first line of the form should say "Québec residents do not have to fill out the rest, but you must submit the form". This way, the immigration officer would not be confused.
DOCUMENT CHECKLIST - SPONSOR (IMM 5491) should not distinguish between Québec residents and non-Québec residents. Québec residents should submit the same forms, but the forms themselves should say that this form must be submitted but does not have to be filled out.
Do not offer Canadian Citizenship for the baby of a sponsored spouse at this stage even though he/she may qualify. This can be done after landing.
Do not demand an additional police certificate after the Promise of Visa letter (POVL) for no particular reason other than the strict application of 1 year expiry date with no flexibility.
Streamline on-line Client Application Status webpage to reflect the real status in CIC's system without a significant lag.
Provide the entire Computer Assisted Immigration Processing System (CAIPS) information in e-Client Application Status on CIC's website as so many people are applying for CAIPS to check the status their application.
Allow on-line submission of forms with scanned PDF documents to CIC/Embassy on CIC's website.
Allow on-line response to questions from CIC/Embassy on CIC's website.
Make a single point of contact instead of separate CIC (telephone only) and Embassy (e-mail and FAX only).
